The aftermath of the attack at the US capitol includes officials’ resignation, arrest, deaths, leaders’ statements, and so on. But on the other hand, there is neither a reply nor a counterstatement from the hero Donald Trump. And lately, one more thing is added to the headline. Yes, Donald Trump is now the sitting president; which makes it hard to take severe actions. But according to the law, he can be impeached. Following the 25th Amendment to the U.S. Constitution.
Well, in that case, you might wonder what do those two things mean? Impeachment is for misusing the powers of the office. Whereas the 25th Amendment is related to some kind of impairment that provides a leader powerless to do his duty as a president.
What is the 25th amendment about?
The law will be provided by the Vice President and a majority of prominent officials or Congress; to the President pro tempore of the Senate and the Speaker of the House of Representatives.
This will be about their written declaration of the President’s disability to terminate the powers and duties of his office. Meanwhile, the Vice President can instantly take over the powers and duties of the office as the sitting President.
Indeed the only job assigned to the president is to propose his declaration. On the other hand, if the Congress disagrees, then the VP and prominent officials can intervene.
The 25th Amendment against the past leaders:
This is not the first time but during the mid-1960s congressional debates over the provision in 1967. Many members concentrated their attention on three cases.
Firstly, the deathbed experience of President James Garfield in 1881; secondly the post-stroke presidency of Woodrow Wilson starting in 1919. Also, President Dwight Eisenhower who suffered from heart problems; eventually approved the transfer of power to Vice President Richard Nixon.
Having said that, Senator Birch Bayh of Indiana, a supporter of the Senate resolution that eventually came to be the 25th Amendment. It states that “The ability to perform the job would be the prime evidence that would determine whether a president was disabled or not.”
What made administrators turn against Trump?
Lately, Trump is very much noted for his behavior. Especially after the attack at the US Capitol. Moreover, he has been accused of not providing credential facts during the election time. And now he is in charge of the attack. As I did tell there is no answer from Trump’s side. Accordingly, it is certain to point the 25th amendment against him.
